Terms and Conditions of bbcat Inc. Cat Boarding Services

We at bbcat, urge you to read the terms and conditions carefully before accepting them. We aim to do our best to make your cat’s stay as comfortable as possible.
1. Introduction
Welcome to bbcat, located at 3057 Postridge Drive, Oakville, Ontario, L6H 0S1. These Terms and Conditions ("Terms") govern your use of our home-based, cage-free cat boarding services ("Services"). By engaging our Services, you agree to be bound by these Terms, which are designed to limit liability, protect our legal interests, and ensure humane treatment of animals in full compliance with applicable laws.
2. Legal and Regulatory Compliance

Our operation aims to comply with Ontario’s Animal Welfare Act, 2019, S.O. 2019, the Ontario Animal Health Act, R.S.O. 1990, c. A.18, municipal bylaws of Oakville, and all relevant federal laws, including the Criminal Code of Canada, particularly provisions relating to animal cruelty.

Our property and operation adhere to all applicable land use and zoning laws, and we maintain all necessary licenses or permits required under municipal regulations.
3. Eligibility and Owner Representations

Owners warrant that their cats are full indoor (We define an Indoor cat as a feline that is constantly accommodated in an HVAC-maintained area at all times and has not been outside the primary residence, unless inside a pet carrier) and, in good health, and have received all required vaccinations (including rabies and feline distemper). Proof of vaccination must be provided before boarding.

Owners confirm that all information provided (medical, behavioural, dietary, accomdation) is truthful, complete, and accurate. Any misrepresentation may result in liability for damages, injuries, or illnesses.

Owners shall disclose any known health issues, contagious diseases, or behavioural problems and agree to indemnify bbcat Inc. against any damages or liabilities caused by undisclosed information.

Owners agree to indemnify and hold harmless bbcat Inc., its officers, employees, agents, and affiliates from all claims, damages, or liabilities arising from false, incomplete, or misleading information.
4. Transportation and Carrier Requirements

All cats must be transported in adequately spacious, secure, and clean carriers that allow comfortable movement, ventilation, and safety. Carriers must be in good condition and appropriate for the size of the animal.
5. Services Provided and Supplies

All cats are provided with adequate shelter, fresh water, litter, and enrichment, as required by provincial and Ontario SPCA standards.

Owners are responsible for providing food and food bowls.

Our care practices meet humane standards, but inherent risks in communal, cage-free environments, such as minor injuries or stress, are acknowledged and accepted by owners.
6. Owner Responsibilities and Warranties

Owners warrant the accuracy and completeness of all disclosures regarding their cat’s health and behaviour.

Owners shall promptly inform us of any changes, issues, or concerns regarding their cat(s).

Owners shall ensure their cat is healthy, free of contagious diseases, and not suffering from parasites at drop-off.

Owners shall ensure the cat(s) are identifiable by either:

a microchip, implanted by a vet, or
-
a breakaway collar on which:
-
the owner's name and address are permanently inscribed, or
-
an Oakville & Milton Humane Society cat tag is attached.

Owners shall not subject animals to neglect, trauma, or harmful treatment prior to or after boarding.

Owners agree to pick-up/drop-off the cats at the agreed-upon time durations; any delays may result in additional charges.
7. Liability, Risks, and Assumption of Risk

Owners acknowledge that risks such as minor injuries, fights, or food-related issues are inherent in a communal, cage-free environment.

Feline interactions: Owners understand that cats may engage in play or minor conflicts, which may result in scratches, bites, or injuries. While we montior and supervise cats staying with us, we do not guarantee the absence of such incidents and waive claims for damages unless caused by gross negligence or willful misconduct.

Food ingestion: Access to other cats’ food may and the stresses of relocation may cause gastrointestinal upset. We are not liable for such health issues, provided reasonable supervision is maintained.

Injury or illness: bbcat Inc. shall not be liable for injuries, illnesses, or damages caused by interactions, fights, or ingestion of food, unless directly caused by gross negligence or misconduct.
8. Veterinary Care, Reimbursement, and Misrepresentation

In case of injury or illness, we will attempt to contact the owner. If unreachable, the owner authorizes bbcat Inc. to seek veterinary treatment at the owner’s expense.

The owner agrees to reimburse bbcat Inc. for all veterinary expenses incurred, including consultations, medications, and treatments, at the prevailing rates of the attending veterinarian.

The owner shall be responsible for damages, costs, and legal expenses resulting from fraudulent misrepresentation or failure to disclose relevant health or behavioural information.

Owners shall indemnify and hold harmless bbcat Inc. from claims, damages, or liabilities resulting from such misrepresentations or concealment.
9. Indemnity and Limitation of Liability

Owners agree to indemnify, defend, and hold harmless bbcat Inc., its officers, employees, agents, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

Misrepresentations, concealment, or failure to disclose relevant information;

Breach of these Terms;
-
Negligence, misconduct, or violations of law by the owner or their pet(s);
-
Injuries, illnesses, or damages caused during boarding.

To the maximum extent permitted by law, bbcat Inc. shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including emotional distress or property damage, even if advised of the possibility.
10. Property Liability and Access

bbcat Inc. operates on property located at 3057 Postridge Drive, Oakville, Ontario, L6H 0S1, which complies with all land use and zoning laws.

Visitors and clients acknowledge that they do not have the right to enter areas of the property not designated for client access and agree to hold bbcat Inc. harmless from any claims arising from injuries, damages, or incidents occurring on the premises, except where the said claims were directly caused by gross negligence.

Owners shall not trespass, or access prohibited areas.
11. Maximal Damages and Reimbursements

The maximum liability of bbcat Inc., whether in contract, tort, or otherwise, shall be limited to the greater of the total amount paid by the owner for the current booking or CAD 1,000 whichever is lower..

Owners shall be responsible for damages or costs exceeding this cap resulting from misrepresentations, neglect, or misconduct, including legal expenses.
12. Privacy and Data Use

Personal and veterinary information will be securely stored and only used for service delivery, legal compliance, or defence.

The owners agree to utilization of their pets’ pictures, videos and other media on bbcat’s official website and social media. Only the pictures and videos taken during their stay will be utilised.
13. Governing Law and Dispute Resolution

These Terms shall be governed by Ontario laws and Oakville bylaws.

Any disputes shall be resolved exclusively in the courts of Oakville, Ontario.
14. Amendments and Notices

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website or communicated directly.
15. Entire Agreement and Severability

This document constitutes the entire agreement. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
bbcat Inc. is committed to humane, lawful, and responsible animal care. Owners acknowledge reading and accepting these Terms, including liability limitations and indemnity provisions, to protect both parties.
16. Visitor Liability Waiver

Owners, clients, and any accompanying persons acknowledge that they enter bbcat Inc.'s premises at their own risk.

bbcat Inc. shall not be liable for any injury, illness, loss, or damage to persons, including pet owners, family members, friends, or visitors, resulting from their presence on the property, unless caused by gross negligence or willful misconduct.

Visitors agree to take all reasonable precautions to ensure their safety and to comply with all posted safety notices and instructions.
